About Mediation

What is Mediation?

Mediation is a voluntary and confidential process where a neutral third party—known as a mediator—helps individuals or groups resolve disputes and reach mutually acceptable agreements. Unlike a judge or attorney, the mediator doesn’t take sides or impose decisions. Instead, they guide productive dialogue, foster understanding, and encourage creative solutions tailored to each party’s needs. Mediation offers a respectful and efficient alternative to litigation—saving time, money, and stress.

What Does a Mediator Do?

A mediator is like a skilled guide in the middle of a conflict—someone who helps people talk through their differences and find common ground without taking sides or making decisions for them.

Facilitates Communication

Mediators create a safe, respectful space where each party can speak openly and be heard.

FAQS

Frequently Asked Questions

Yes, absolutely. Mediation is a private process, and what’s discussed during sessions generally cannot be shared outside of mediation—unless both parties agree or there’s a legal exception.

While we’re equipped to help resolve a wide range of conflicts, Upturn Resolutions specializes in family and divorce disputes and employment-related issues. Our goal is to provide a neutral space where each party feels heard, respected, and supported in finding lasting solutions.

Here are just some of the matters we can mediate:

Family & Divorce Disputes

  • Parenting plans & custody arrangements
  • Child support and financial responsibilities
  • Alimony
  • Co-parenting communication
  • Division of assets and property
  • Separation agreements
  • Visitation schedules
  • Prenuptial or postnuptial agreements

Employment Disputes

  • Workplace conflict and communication breakdowns
  • Employee/management disagreements
  • Harassment or discrimination claims
  • Wrongful termination concerns
  • Contract negotiations or disputes
  • Performance or disciplinary issues
  • Exit agreements or severance terms

If you’re facing a different kind of conflict, we’re happy to explore whether mediation is the right fit. Many disputes can benefit from a collaborative and impartial process—even if they fall outside traditional categories.

No lawyer is required, but you may choose to consult with one before or after mediaon to better understand your legal rights. Just keep in mind: mediators do not provide legal advice. We facilitate productive conversation to help you better advocate for yourself in a professional, respectful environment.

The length varies depending on the complexity of the issue and the willingness of both parties to work together. Some sessions resolve conflict in just a few hours; others may require multiple meetings over time.

If no agreement is reached, you still have the option to pursue other legal remedies, such as arbitration or litigation. Mediation often clarifies issues and sets the stage for resolution—even if it doesn’t fully settle the matter.

If an agreement is reached during mediation and it is documented and signed by all parties, it can become legally binding. It’s always wise to have legal counsel review any signed agreement if you’re unsure.
